How to dissolve the existing managing committee

hi,

i live in a cooperative society in malad
teh existing managing is not working properly,doing all the transactions in cash without proper supportings and threten the members and after asking for the copy of bills the committee memebers misbehaved and lodged a falsoe complaint of physical harrasment against my husband.

what action should we take to dissolve this committee and to protect ourselves from further false police complaints?

requisition an special general body meeting for dissolving MC . obtain signatures of other members . if MC does not call for SGM complain to regsitrar tthat in spite of rquisition MC not called

Make a written complaint of the same thinker residents/members of the society to the local registrar of your area and demand strict action failing which approach high court by engaging a lawyer.

No confidence motion against the MC is a proper solution for improper working of the Managing Committee.

Normally, byelaws of every society provide for the replacement of the committee by passing no confidence motion by 2/3 majority of members in the GB or special GB. So, muster strength by getting support of majority of members of the society, requisition calling of special GB meeting, put your resolution of no confidence motion before the GB against the MC and get passed by 2/3rd majority.

If the MC fails to call for the GB, a specific number of members can call for special GB themselves, as per the provisions of byelaws. So, check the byelaws about such provisions.
