(Querist) 30 May 2012 This query is : Resolved 
X (UP) SOLD GOODS TO Y(DELHI) AGAINST C-FORM.
WHEN GOODS WERE IN TRANSIT Y(DELHI) SOLD THE SAME GOODS TO Z(UP).
CAN THIS TRANSACTION BE TREATED AS SALE IN TRANSIT SINCE THE MOVMENT OF THE GOODS TAKE PLACE IN THE SAME STATE.
PLEASE CONFIRM.

Mr. Suhail has to clarify as to where from he gets the requirement that such transaction should cover "THREE STATES". What will happen if only two states are covered in such transaction, will it not be a valid sale? I think Suhail has to come out very categorically. I am damn sure Mr. Suhail is not correct when he says there should be three states for such transactions.

Under the the CST Act the goods must move out side the state physically and sale should not be concluded in the same state. In this transaction the goods are not moving out of the state so this sale will not be covered under the CST Act.
