Landlord not giving noc to repair leaking roof

(Querist) 13 April 2012 This query is : Resolved 
If Landlord have room on first floor, and not residing there. To vacate tenant, he himself break cement roof, to harass him, this is same situation. BMC ask NOC of Owner, who refused to give. .

What can be done ??

Can tenant repair , entering owner's room. ??
It is not possible to go up without entering 1st floor[top floor] room in his possession.

The tenant can file a suit for repairing the premises and go on repairing himself with option to deduct the costs from his rent.

It is the duty of the landlord to keep the tenanted premises in habitable condition.

Problem is the Landlord do not allow to repair. can tenant trespass / open his room to go & change tiles/ replace cement sheet.

Tenant on ground floor. Land lord room, unused for years, have tiles. / cement roof.
One side municipality issued notice to demolish this 60 years old structure ,[at instance of landlord] & Tenant prove, building cannot collapse being heritage type, stone masonary & obtain stay from court. As only one room in entire compound, he received this plot before two years from deceased childless "masi" and want to sell it & cash money. Landlord want tenant to go at all cost.

So BMC & landlord, both are against tenant, and coming monsoon, tenants will not be able to reside, with family of 6 person.

Pl guide , any trick to repair leaking roof, allow tenant to live peacefully?? Any Human Right?? Any way to replace roof tiles/ sheet.?? ??

Seek an order of repair from court and get repair don by commission appointed by court for this purpose.
