Proof of cause of action

(Querist) 05 February 2012 This query is : Resolved
I had read a case law having a ratio that if a civil suit is contested by filing W.S., the cause of action is proved and no further proof is necessary to prove Cause of Action; but I don't remember. Will you be kind enough to please give such citations ?

Dear Sir, The query relates to injunction simplicitor suit relating to land wherein the defendant alleges that he is common owner and he is in joint possession of the suit property. The land purchased by me under tenancy act. All the revenue records stand in my name and I did not give oral evidence. It is in this context that I had submitted the said query. Would you please answer ?

I don't think that there would be such a case law, that by filing WS, cause of action is proved. In the written Statement itself, cause of action can be challenged.
