Dear Sir/Madam,
If husband and wife ready for mutual divorced and both sing paper. Then if necessary to go court to submit paper both husband and wife or anyone can submit the paper in court. And further process go head.

If they have signed and verified affidavit also their lawyer may file suit. But in later stage they may their presence may be necessary .

The presence is must for recording of the statement of both husband and wife.

I do not agree with arvind.
Not only both shall have to appear before the concerned family court for filing the petition but they have also to make a statement in support of the petition seeking mutual divorce. The petition shall then be adjourned for a date falling after 6 months when those both shall have to come for second motion/statement.

Only in Family Court the presence of both parties is must. But in the case of court of District judge advocate of any of the parties can file such case. Presence of any of the two is not necessary at all.

The suit can be filed by the advocate but at the time of the statement both the parties must present in the court and than after that the case is adjourned for 6 months

Thanks sir,
So If I will prepare the paper and sign from my wife and my advocate submit that paper in court and when we get the date then my wife and me will present in front of court and then further process will go on.
So my wife not required to go and submit the paper in court just sign it then its ok.
