Respected Members, I lost two of my signed cheques bearing amount 25,000 each but it didnt beared the name to whome i am giving the cheque i.e. the PAY line was empty. Some one known to me got the cheques and xeroxed it after that he handed over that cheques to me. My query is " Is there any possibility of legal action against me?"." Does xerox copy of cheques bear any importance in case??" The cheques are with me and still bear only the amount and my sign.

If you have got the originals cheques with you then nothing to worry. The photocopy of the cheque is not a negotiable instrument or valuable security.

If the xerox is wihout any name and since the originals are with you there is no risk, hwoever if he has taken any acknolwedgement of return from you and the payee name was also filled up, many stories can be made to trouble you.

PHOTO COPY OF THE NEGOTIABLE INSTRUMENTS ARE ACCEPTED ONLY DURING THE TIME OF TRIAL BUT THE SAID ORIGINAL CHEQUE IS HAVING YOUR POSSESSION SO THAT SECONDARY EVIDENCE ALSO DENIED, IF YOU WERE THREATENED BY HIM YOU GO AND PREPARE A POLICE COMPLAINT AGAINST HIM AND EXPLAIN ALL THE MATTER.
