NOT GIVING BONUS

Dear Sir,

This is in reference to my Bonus pending of Previous Employer.

My name is Mrinal Dutta from Mumbai.I was working with a Singapore based MNC. I have worked almost mre than 1.6 years and was a confirmed employee with having Appointment letter letter and confirmation letter too.

I left the company in the month of Aug.2010, have given resignation and notice period and company re leaved me with releaving letter and experience letter.

When i have demanded my Bonus for this Dewali they ignored this. I have put then mail regarding the same but there is no reply, saying that as per singapore rules company is not giving salary who left the company.

Is this true??
Please advise me for what to do in this case as my PF is also pending.

the question where you were posted at the time of resignation, whether your employer is registered under any Indian Act, what were your service conditions is still required to reply your query. in the absence of above fact, it is not possible to reply.

You are advised hereby issue a legal notice.If your problem not resolved by the company, file a civil suit against the company.

If you were in India working in that company then first your job contract is to be seen as it will determine the rights and privileges of the company.Do remember the Bonus applies to the workmen only and to the while collar staff. However, the company at the same time can not reprieve a worker for his legitimate dues which arose out of his labour.

There is an Authority appointed under the Payment of Bonus Act who usually is Dy./Asstt. Labour Commissioner. File a complaint regarding non payment of Bonus.
As far as PF is concerned you have to approach Regional Provident Fund Commissioner with your complaint. Any establishment working in India irrespective of its origin has to follow the Labour Welfare Legislations.
