in ancestral property of"A" his wife who resides seperate from "A' many years is she entitle to claim partation in that ancestral property of "A".I get one caselaw'MHLJ 2006(3)PAGENO416.I WANT SOME CASELAWS RELATED TO THE ABOVE SAME MATTER

she cannot claim partition in husbands ancestral property.can u pass on that citation,u dint say if it is favouring such partition or against it to my knowledge she cannot as told earlier

As per SC, A Hindu wife claiming divorce can also claim 50% stake in Husbands property whether movable or immovable:)

Wife is not entitled to get the ancestral house property partitioned during the life time of her husband. No citation ia available in support of partition.

wife cannot claim share in the ancestral property of her husband during the life time of her husband, if she has got children thru., them she can claim.
