Payment of Gratuity

(Querist) 22 April 2010 This query is : Resolved 
I have served for 4 years and 6 months continuously in a company. Can I claim Gratuity? Is there any provision for claiming Gratuity. Please let me know.

You are not eligible for gratuity as per the provisions of Payment of Gratuity Act. Minimum period one should have served for entitlement to get gratuity is five years.
