Thank you everyone in advance for taking the time to read through my post and give your valuable feedback. It is highly appreciated.
I would like to know how to proceed with a registration of property which belonged to my Aunt who has now expired. She had written a will on the name of my Father and his brother who is in US with whom we have lost all touch for the past many years. According to the will it was stated that the property an apartment be divided between both the brothers. It also states that the brothers both are taking care of my Aunt all her needs and maintenance which is not true since My Uncle who is in the US has not visited India in over 10 years or even sent a rupee towards the maintenance of my aunt when she was alive. Even before her death when she was admitted and all rituals for which we spent over 10 lakhs not a single penny was given by him.
We were now wanting to sell the property which is around 25 Lakhs to the maximum as it is a very bad condition as it over 30 years old building.
I seek your knowledge on how do we go about to sell the property and what legal steps do we take towards the registration of the property.
All your valuable feedback and expertise is highly appreciated.
1) Take both brothers name on record every where as per will
2) File Partition suit of property , get partition done
3) Sell the Property ----------------------------------------
1) If you want to search your uncle there are various ways online to search in USA including paid search engine do research
2) Contact him
3) Get registered Power of Attorney done in embassy on some one name
4) With your father signature and POA holder signature you can sell the property

From the facts stated, it is impossible carry out the sale without the involvement of your uncle.

Get the property transferred in the name of both brothers on the basis of will. Your father can sell his share, if your uncle does not cooperate.
