Deduction on Refund of Booking amount

Dear Experts,

Please guide me with regard to rules of dedcution on the refund of advance booking amount paid to builder due to cancellation of booking before the agreement is made.

No straight jacket rule of deduction is available. There are the terms and conditions accepted mutually by the builder and the person booking any land/flat with him which prevail in such matters.

Your agreement for sale being covered by the provisions of Indian Contact Act, the calculation for deduction of booking amount because of cancellation is to governed strictly by the terms and condition of the agreement itself
