The undivided ancestral property inherited from paternal grand father located in Kerala belonged to two legal heir has been trespassed by a third person based on a forged WILL . WE the legal heirs claimed injunction & it was granted and suit is pending.
Police refused to file FIR for his trespass and forgery . At this stage can I (legal heir ) file private criminal complaint u/s. 200 Crpc before the concerned Magistrate for forgery and trespass ?

If so what is the procedure for filing private complaint u/s. 200 Crpc ?

Devajyoti Barman (Expert) 22 November 2013
Why private complaint, go for petition u/s 156(3).
However since it is civil dispute the court may refuse to take cognizance of the case.

Agree with the expert Devajyoti Barman ji.
