Police enquiry

(Querist) 11 September 2013 This query is : Resolved 
we the petioner filed a complaint against respondant in womans police station in halasur. preliminary enquiry was conducted. could not be reconciled. they referred the matter to vanitha sahayavani. petitioner didn't attend second enquiry. Engaged a lawyer and filed a case of divorce and dv on respondant. after filing the case respondant went to another police station and lodged complint on petitioner. Inspector called the petitioner and said she has to attend the enquiry. petioner consulted her lawyer and lawyer said not to attend the enquiry as the case has already been filed and registered against respondant.

By not attending the enquiry will the inspector arrest the petitioner or take any other legal action. the respondant is a big rowdy. It seems he has bribed the police to conduct the enquiry.
pls advice us we are in deep trouble ?

Nothing wrong assisting
Police to investigate any crime.

Being Lady, Police cannot trouble her in family matter.

It is common that Police machinery works after oiling and patrolling their car.
But they cannot go beyond Law. Their co-operation and support in FAMILY MATTER is restricted, and fvr Lady.

petioner is really affraid to attend police station and becomes nervous. seeing this only her lawyer said let the inspector talk to me. can petioner refuse to attend the enquiry

The respondant hsa stated the following in his complaint
The petitioner is not taking to me nor receiving any phone cslls. The petitioner is not responding to any of my emails or messages. the petioner is a joint owner of a company floated by both and the respondant says she has to tender her resignation to the company. The petitioner says she will not resign unless and untill both the cases are completly solved

The complaint does not disclose commission of any crime.

REFUSING TO TALK OR DENYING TO ACCEPT PHONE CALLS IS NO OFFENCE AT ALL.

SO IS ALSO THE CASE OF MESSAGES AND EMAILS.NOT REPLYING THEM IS NO CRIME.

SO ALSO THE REFUSAL TO RESIGN FROM ANY OFFICE IS NOT A CRIME.FOR THAT COURSE PROVIDED IN LAW WOULD BE FOLLOWED.

IT DOES NOT APPEAR TO BE CASE IN WHICH POLICE CAN MAKE ANY INQUIRY AS MATTERS COMPLAINED OF ARE OF CIVIL NATURE.
