What if the magisrate don't consider the 239 crpc application and proceeed for framing charges?

Sir,
In 498-A case,my lawyer is intended to file the 239 for discharge under CrPC but also doubts whether the magistrate without entertaining the application starightaway for framing of charges..In taht if the charge is framed whether there is any remedy to proceed against for non enterataining the application for discharge??

At the time of charge hearing or son thereafter you can move discharge petition.
