Can i file the application under section 340 of cr.p.c for perjury?

I filed a civil writ petition in High Court Mumbai. It is in pre-admission state. One of the Respondents filed the reply affidavit requesting the court to reject my petition.This affidavit of respondent contains many false averments. When Should I file the application under section 340 of Cr.P.C for perjury against him? If the Court rejects my petition what shall I do? My lawyer is not co-operating me. So please suggest me.

no . fight your case on merits . convince the court that allegations made in reply are false . dont waste your hard earned money on filing perjury application
