Sir,
This is in connection of Thread posted about 2 days ago and opinion of Defense Advocate was posted a day ago

The Additions/alterations carried out by the tenant have been noted by the B M C in their M R T P notice .Also the Landlord has given complaints to B M C. The original sanctioned plans and Final O C plans are with the landlord which clearly show the position of of earlier lay out and altered lay out.

Apart from the above discrepancies the Tenant has changed the original status of tenancy.Also with pendency of the suits in Small cause court and city civil court he has added the name of his son in the tenancy which is pleaded as proprietorship concern

The Tenant has taken order from the court to deposit Rent/Taxes and permitted increases in the court.Dispite of this he has not made payments In fact the advocate has made an affidavit that they are NOT liable to pay B M C taxes to the Landlord.These taxes have been paid by the Tenant before the inception of suit and also after sending notice for non payment of Rent/Taxes by the Landlords Advocate.
