(Querist) 23 February 2013 This query is : Resolved 
Sir, In any mutualsetlement, whether the setlement payment can be given to girl first when she signs the terms ?
And when she should take back all other cases like DV. When the decree passed. (When money step, when case back, when decree?)

And after signing setlmnt terms, if any affidavit needed from girl or boy? or after terms no document needed to sign by anyone.

Will the signed terms be a part of decree passed?

Make a comprehensive Agreement.

Mention all the details of periodical payments to be made. Rather than making one time payment, its better to pay in installments.

Let the mutual agreement be supported by a duly sworn affidavit of both the parties.

Consent term is non appealable and binding on both the parties.
CONSENT TERM IS ENOUGH, AS DECREE WILL BE DRAWN ACCORDINGLY.
No need for Affidavit.

It is highly dangerous to make full payment on first statement. It should be paid through a third party after final statement.
