Regiatration or marriage

dear experts
my brother married in 2010 not staying with her wife from the date of merriage merriage not consumated as well
can he file pitition for null and void merriage from the
place of merriage registration or from 3 places(same for divorce)
he never stayed with her at registration place

once you can prove it, than automatically comes under divorce.

I dont think its a case of S. 12 of Hindu Marriage Act.

Better move a divorce petition u/s 13 of HMA, 1955

If the facts told by you are true even then what was your brother doing since last 3 years?

Obtain divorce on this ground coupled with desertion.
