Me & my wife living separate from each other. I am living in Rent house & my wife living at my mother house. My mother has been dispossession from her property through Legal notice me & my wife. But my wife and my mother in law & father in law living in my mother property. Now she filed a complaint against me for maintenance in family court & also filed a complaint in CAW Cell. So I want to know how is percentage of maintenance on husband salary. Can my mother file a maintenance case on me.

it would deped upon your income. generally around 30%of your income
you mother can also file for minatenance if she is unable to maintain herself .
if your mother has disposessed you and your wfie from her property how is your wife and her parents living in your mother property

Yes, my mother is unable to maintain herself. she is 55 yrs old lady. Can u confirm if my mother also file a case for maintenance, then how is percentage of maintenance both side divide (Mother + Wife) for distribution of my salary.

If both mother and wife files for maintenance. Both would be entitled to the same.
Both would get around 20% of the salary.

Your mother is also entitled to seek maintenance from you like your wife. Your mother should get her property freed from the encroachers first.

However, if it is ancestral property, no will is going to affect your rights on the said property.

Bedakhli/ Dispossession etc. has no bearing, if the person dies intestate.
