Divorce case start

hi

my divorce case is going to start, i had delayed it til chargesheet under 498a was filed.

what would happen in first hearing, normally how much time judge spend on each case on a day. would judge hear entire allegation by wife in first hearing itself,

what is the procedure of witness in family court

please share you expereince.

You have yet to file your petition. first file it then notice to your wife shall be sent and further proceeding shall initiate accordingly.

It is not a matter of your consideration to think how much time court shall take as none can be anticipated.

error on my part, i did not mention issue clearly

divorce petion filed by wife in mar 2011, seperate 498a case,, chargesheet filed by police, i would be appearing in that case speratelry,
my question is for divoce case, what is the normal procedure, medition has failed..

Generally on first meeting the court tries for reconciliation.

On the first date, you will be directed to undergo counselling before the counsellor of the court. After counselling of both parties, the report of counselling is forwarded to the judge by the counsellor. if there is no chance for reunion after counsellling, further procedures starts such as WS, evidence, cross examination, argument etc.

We cannot say how much time it will take. It depends on case to case.

He said "medition has failed.."
As your wife is petitioner, you are bound to file your SAY [WS], and issues will be framed.
After the issue, your wife will file her Evidence Affidavit, and your Adv will cross examine wife.
Later You will file ur Evidence Affidavit, and your wife's Adv will cross examine you.

Judge have no time to hear everything the same day. It will take years.

Go in court room, listen to proceedings. & you will learn all procedures better than experts.

Remember where Hussy makes mistake to reply cross exam questions, and u try to ratify such mistakes to WIN your case.

BUT WHY YOU WANT TO WIN THE CASE.
LET HER WIN. YOU DO NOT APPEAR, LET HER GET DIVORCE.
WHY WIN CASE AND LOOSE LIFE. BETTER LOOSE WIFE.

thanks shroff sir for detailed response.
i do agree with you, i am wasting my time, money .. but can we mesure everything on profit and loss.
for example my mother was operated 4 years back, as per doctor chance of survial after operation was 1%. even then my father put all resource he had for operation, what would happen if it was not sucessfull. Can i justify him not putting best effort because of low chance.

anyway, i would give MCD to her day she tell the truth in court or I prove the truth in court.
Till then I would continue to learn from this site.
