Hi,
I purchased a flat last year in Month of May 2011 in Mohali. I have paid 50,000/- for car parking, however now I came to know that there's a law whereby builders cannot sell parking space. The building where this apartment is, has 80 flats, however the stilt parking available is not sufficient to provide car parking to all flat occupants. Builder has provided open parking space also, however he's asking for another 50,000/- if somebody wants covered parking. Can you please help me with 2 points:
1. When was the law passed regarding builder cannot sell parking space and if it was passed before May 2011, then how can I get my amount refunded.
2. Can he further charge 50,000/- for covered parking?

1. You have misunderstood the law passed by Hon;ble Supreme Court. Builder cannot sale the parking space means he cannot sell it for any other purpose then for parking. Parking space is meant just for parking which is clear in your case.
2. It is his term. You may negotiate with him.

If you want covered parking, builder demanded further Rs. 50,000/- as cost of const of parking shed., otherwise all other Parking is open in stilt.
It is negotiable, as a special case. u hv rt to cancel parking, if he can't provide, he is bound to return your amt.
