Divorcee validity.

(Querist) 02 March 2012 This query is : Resolved 
sir, i have taken divorcee with my wife on Rs. 100 Stamp paper with present of two witness and signed by Nottary. It is clearly stated in that document that all maintenance for her life time is given and she has no right for further claim of it. I have receipt with her sign clearly stating that, all the articles called 'Stri dhan' is given to her.

Although she filed 125 against me stated that the sign on the paper was taken from her by force. & She is totally ignorant about the paper on which she was signing.

First she filed 125 on her hometown. but after 7 months she withdraw the case with a right to reopen at any other court. The reason given by her was that she is changing her living place.

Just after 15 days she re open the case in my hometown, Family Court. Because in this court Maintenance is much more than others.

My question is: Is she eligible for maintenance? and Is Divorcee is valid?
We both are of Brahmin communities and im government official.

1. yes she is eligible for get maintenance
2. no its not valid

you can get divorce from the court only,

This divorce is not valid, who soever told you its valid.

And any ways your wife can always claim maintenance.

You have become enemy of yourself. Overconfidence without any base provides the same fruits you are eating.

Neither divorce is legal nor you are exempted to provide maintenance of your wife irrespective of her change of court.

1.The divorce can be validly done only by decree passed by court.your's one is a waste paper in the eye of law.

2.Her petition under section 125 Cr.P.C. is maintainable.However as she is also employed,in reply, you can plead that she is employed and can maintain her from salary she earns.
