Land grabbing

Hi sir.. We have one home in Chennai around 1800 sq.feet that is very old building nearly 27 years in that time they build home at 1600 sq.feet remaining 200 sq.feet they have put empty place in that land also included in my documents. Now we plan to build a new home at totally 1800 sq.feet but in nearer home person told that is common place for both so he is not allow to build that 200 sq. feet. he is having political support and police support so we cannot do anything please give any suggestions to solve this problem.. And in that area he is build window and put some pipes also.. And that person he is not having any job just doing give money and collecting interest for people.. And one more things he is build nearly two sq. feet for government roads. in that place they put steps and temples everything..if i am going to give compliments it is solved or not? and all are telling it takes many years so i am totally confusions.. please give suggestions for my problems..how can solve this problem..

File a suit for injunction.

You shall have to file suit for possession rather of merely injunction.

Only two way to resolve.Either amicably or by Court.First get a plan of construction passed.If he raises objection and your plan is refused to be passed due to his objection
then you would be forced to file suit for injunction if he has only stray pipes on your land.His windows ,if proved to older than 22 years at the date of suit may make him entitled to right of easement over your open land.

About his encroachment on road side land ,you should file complaint in department to whom road belongs,may be corporation or PWD for removal and in case they do not pay heed ,you can file writ in High court for this purpose.
