Dear sirs, i lost my property papers of shop in july 2007 floods in mumbai. How to obtain papers

Which papers you lost???
ajay sethi (Expert) 14 January 2012

Ask the society for a duplicate share certificate. You will need to file an affidavit and an application for a duplicate. Read up on the by-laws of the society to find out how this is done. A copy of the by-laws will be available with your society's managing committee.

You can also approach the office of the Registrar and ask for a copy. In this case, you will have to give some information like the date of registration or the registration number

You have to apply for certified cipies frm the Registration Office.

You might have the photocopy or the particulars of title of your shop like its sale deed no. and date.

If it is available, obtain its second certified copy from the office of registrar as there is no role of society in such matter.

if shop is located in cooperative society and he has share certifcate as member of society he will need duplicate share certifcate too

Dear Sirs,
What if all the documents including photocopies are lost and he doesn't have any details such as registration no of documents etc are not available?
prabhakar singh (Expert) 15 January 2012
@Deepak Nair!
Then he needs to go far a search/inspection of records at registration office anticipating year of sale.If society is involved ,it record can also be inspected by him when he is it's member.

you can get duplicate copies from concern authority.. or immediately consult an advocate and issue a public notice about your lost documents and not to be make any illegal encumbrances..

author just post an insufficient query., he not yet back., so peoples we may be wait till then, rather than assuming about his problems.

Thank you all experts for your valuable guidance.

The real problem after getting the certified copies of all documents is:

1. The Banks do not give loan on the basis of certified copies.
2. If I sell the shop, the buyer is not ready.
the buyer insists on a Title Certificate from court.

Dear Prabhakar Sir,
Thanks a lot for the guidance.
Deepak Nair (Expert) 16 January 2012
Dear Querist,
In such a situation, it will be better to consult a local lawyer so as to file a peetition for title certificate.
prabhakar singh (Expert) 16 January 2012
I think if loss is reported and a publication of loss is also made then an indemnity clause can do away the problem.
