Actions against non-payment of building maintainance fund

Respected experts,
one member of our four storied flat is not paying building maintainance fund.what action
can be initiated against him though the building committee is not registered.

There should be a provision for the same in the Bye-Laws of the Society.

But since you say that the society/committee is not registered under whom this building comes. Then you'll have hard time if the person is not paying you the maintenance fund.

Are there any maintenances done by the committee? If there are then you can ask for the fund. You will have to prove it though. If you ask me, get yourselves registered first you'll have a better go at it.

1.Make bye-laws include clause for action to be taken for non-payment of maintenance.

2. register society.

is society registered? if so file summary recovery proceedings under 101 of Maharashtra cooperative soceties act

You can take punitive action if the bye laws of the society so provides.
