Harassments and incursion by the management of the company and hold my salary illegally.

It is respectfully submitted as under :
1. That I was working with Fourseasons Group of companies since 2006, promoted by Mr. Dilip Tawadey who is a high profiled and litigative person.
2. That Mr. Dilip Tawadey was booked a flat in Arunima Palace, Indira Puram Gaziabad launched by Sanjiv Gaur & Associates. I and Mr. Narendra Kumar Sankholia (Accountant of Company) along with Mrs. Renu Tawadey along with Mr. Dilip Tawadey visited to Arunima Palace for inspection of flat on 06-08-2009 and that time arise some disputes between Mr. Tawadey. Mr. Tawadey wants to lodge a complaint in Indiarapuram Police Station u/s 307 against Mr. Sanjeev Gaur by using my name to build a pressure on Builder. I was not agreed for that and I was refused. Mr. Tawadey wold like to be know me that when the builder will come for compromise, we will withdraw the case.
3. That Mr Tawadey known me that he lodged a complaint with Indiarapuram Police Station, Gaziabad against Mr Gaur (Builder).
4. That Mr Gaur also filed a case with Hoable Gaziabad Court against Mr Dailip Tawadey.
5. That Mr Tawadey depute me for attend the case on behalf of Mr Dilip Tawdey and I was paid 750/- separately for this case other than Petrol.
6. That in the month of December 2010 I visited to SP City office, Gaziabad along with Mr. Narendra Sankholoia (Accountant of FMPL) and surprised to know it that an FIR lodged with Indiarapuram Police Station u/s 307 against Mr Sanjeev Gaur (Builder) by me (S. K. Sharda), and police is investigating the same.
7. That after return from Gaziabad Police Station, I contact to Mr Dilip Tawadey and asked him, that why he abused me in this case, then he told me that “SHARDA TUM KYUN GHABRA RAHA HAI… KUCHH BHI NAHI HOGA…., DEKHO… JIS TARAH SE MENE APNI PAHUNCH SE FIR KARWAYA HAI…. USI TARAH FIR WITHDRAW BHI HO JAYEGA…”
8. That’s I was not agreed with Mr Tawadey and I think it’s better for me to resign from here, and I was submitted my resignation with Chaiman of the Company Mr Dilip Tawadey in the month of December and the same was accepted by the Management of the Company and requested to work till March 2011 and I will be released by March end or 1st week of April 2011,
9. That my original documents (Educational Certificates) and all dues will be paid at the time of releasing.
10. That in the month of April 2011 I was requested by the Management of the Company to stay till June 2011, because Mr Tawadey is going to London and he will return on or before 20th of June 2011 than I will be released.
11. That Mr. Tawadey persuading me for giving statement of his desire and choice in some criminal cases being persuade by him in Ghaziabad, U.P.
12. That for harassment Company management issued a letter on 10-06-2010 on behalf of Chairman to me for completion of accounts with all adjustments of all 10 companies and individuals.
13. That if I am not giving the statement Mr. Tawadey threatens me to implicate in false and cooked matters relating to fraud and financial matters.
14. That Management retained my Salary for the month of May 2010 and expenses bills from December 2009.
15. That after very next day they sent me a massage “Tried ur phone so many times-u not picking up the call. Please contact office on Monday n come when sir is back. Narender”.
16. That after receiving of this massage I tried to contact Mr. Dilip Tawadey who was out of Country and Mrs. Renu Tawadey director of the company to confirm the massage, but both were not responding.
17. That on Saturday when I go to office, a letter issued to me from Mr. J. P. Gattani signed by Mr. Narendra- : “Mr. Tawadey’s instruction that you are not to attend the office from 12th of June 10 till Mr. Tawadey’s return from his tour next week”. “You are instructed to call and make appointment to meet Mr. Tawadey for further discussion.”
18. That they have been suspended my services without any charging any allegations and also threatened to me to implicate in false and cooked matters relating to fraud and financial matters.
19. That on Monday I contact to Mr. Narendra he told me that Mr. Tawadey has came back and he will inform me latter when have come to office.
20. That I received a call from office that – “ Choice is up to you either give statement as their choice in the cases perused by Mr. Tawadey in Ghaziabad or ready to face problems in your life.
21. That I would like to bring your kind attention that I was working as Commercial Manager and looking after Investment of the companies in Mutual Funds, Stock and Shares and up-coming Hydro Power Projects in Sharan, District Kullu, Himachal Pradesh.
22. That I come to know that management is trying to lodge a complaint against me in false and cooked matter relating to share and stock market activities in which some loses incurred by the company and also some other financial matters as suggested by their lawyer.
23. That on 15-June-2010 I was submitted a written complaint with R K Puram Police Station, New Delhi and copy to Commissioner of Police, New Delhi, request to lodge an FIR against Mr. Dilip Tawadey, Mrs Renu Tawadey.
24. That on 19-June-2010 I received a letter from FMPL Management regarding Charge Sheet dated 16-06-2010 and same was replied on 21-06-2010.
25. Sir, since then I am regularly contact to FMPL Management and request to release my payment but didn’t.
26. Now on 15-09-2011 the Company issued a cheque for 68798/- deposited in my account through cheque as full and final settlement instead of my claim.
Let me help ! How can I recover my dues from the Company.

you write a complaint and file petition before labour commissioner of your jurisdiction .wit all documents.

At first you lodge a diary in the local police station of your jurisdiction stating the material facts in writing and obtain a true copy signed by the P.S.AS RECEIPT. Thereafter you lodge a complain in the office of the Labour Commissioner of the State in writing alongwith the copy of your diary lodged in the police station for relief and redress.

You have not mentioned in your very very long containing unnecessary detail about your total dues.
As you have received most of your dues, it now becomes a civil matter of recovery of balance amount. It is not necessary to submit all such detail. You have to file a civil suit for recovery of your balance amount being you were an employee with the defendant firm. Engage a local lawyer of Gaziabad and file this suit.

Thanks to sankar narayananj, Biswanath Roy, raj kumar makkad. I have already lodged a written complaint (Diary) with local police station.
Because my salary was Rs.26000/- so that labour commissioner has returned my complaint.

Total emolument was Rs.250000/- and as per our last meeting with management, we agreed on Rs.160000/- but now they have deposited a cheque of Rs.68798/- in my account
