Registering sale agreement in karnataka

Querist : Anonymous (Querist) 23 August 2011 This query is : Resolved
Hi,

I am buying a rowhouse from a developer and requested that the sale agreement be registered.

The developer is flatly refusing to do so.

Can someone help me with:
- Is it mandatory in Karnatake to register sale agreements? (not the deed)?

- If mandatory, when was this made mandatory?

- What is the validity of an unregistered sale agreement in case of disagreements later?

Thanks for your help.

any immovable property if more than rs.100/- mean you have to register the sale.. otherwise legally you are weak for your remedy in future.

Thank you for the response.

This is even for the sale agreement? The Seller says they will register the sale deed at time of possession in 2012 but not the sale agreement, that will be signed now).

Through out in India, Agreement to Sell, is NOT required to be compulsorily registered. Registration is optional.

@ Mr. Ramachandran

Thank you for the clarification.

Does the validity of the sale agreement be impacted by its registration or lack thereof?

What are the advantages of registration for a buyer?

I had already indicated to you that An Agreement to Sell is not required to be Compulsorily registered. Non-registration will in no way impact the agreement.
