Rcop case

(Querist) 22 August 2011 This query is : Resolved
Dear Sir,

I have filed the case for RCOP against tenant in 2009 and this is the shop in tamil nadu. Usually how long RCOP will take to complete? Becase tenant still getting the date from the court with a view of delay of the case.

Actually the case has been filed in 2006 by tenant saying that land lord trying to vacate him with force, they do not have right to vacate because we pay regular rent and this case has been dismissed by court in favour of us saying that tenant is not paying regular rent and there is no rental agreement in force after that only we file RCOP case in Aug 2009.

Please provide me your opinion.

Best regards,

Hameed

RCOP cases take minimum 2years for decree, if you have primary evidence then only you will finalised your case.

Expert is right, moreover time consumption in such cases can be guessed only.Any intervening incident such as death of a party may drag it years in substitution alone.

Usually the tenants used to delay the case, if the case is against them. They will wait for the right turn.

So, request your advocate, to expediate the matter.
