RESPECTFUL LD MEMBERS.
QUERY IS VERY SIMPLE BUT I WANT TO KNOW OPTIONS AVAULABLE TO ME.HOUSE IS REGISTERED IN MY FATHERS NAME.BUT MY BROTHER IS LIVING THERE FOR SAY 4 OR 5 YEARS.MY FATHER WANT TO GIVE THAT HOUSE TO ME.IF THIS IS THE INTENTION OF MY FATHER CAN I OUT MY BROTHER FROM SAID HOUSE.HOUSE IS SELF EARNED PROPERTY.WHAT LEGAL ACTION CAN I TAKE FOR DISPOSSING MY BROTHER.AND WHAT MODE OF TRANSFER SHOULD I APPLY IN ORDER TO GET THAT HOUSE INTO MY NAME.MY BROTHER WIFE IS ALSO TAKING BENIFIT FROM SAID HOUSE(BECOUS MY BROTHER & HIS WIFE IS LIVING RENT FREE IN THAT HOUSE AND CLAIMS BENIFIT WHAT GOVT PAYS THEM FOR RENT) IN MATTER OF RENT . HOUSE IS SITUATED IN HARYANA.

Ask your father to execute a gift deed or sale deed in your name. then talk to your brother to settle the matter amicably to vacate the house. if he refuses file a suit for eviction.

In my opinion GIFT would be a better mode take this property from your father unless you have money to pay in white the adequate consideration for a SALE.
your father can also evict him even before execution of any document gift /or /sale in your favor,and you can become a party to that after gift or sale is executed. I suggest let your father file an eviction case against your brother,there after let a gift or sale be executed in your favor and then you get imp leaded in the suit as plaintiff replacing your father.
