Does an individual have to deduct TDS whilst making payment to his advocate (who is also an individual - not company)?

I am not sure what you are talking about. I am also not sure whether you have any legal provision backing up your views. If you have any provision, please indicate.

TDS may be deducted from the lawyer's fees under section 194J subject to that in the preceding year the books of accounts of the individual was audited under section 44AB
