please advice me

a private complaint can be filed for breach of contract punishable u/s. 406 Cr.p.c., because section 405 also includes breach of any legal contract.

a contract was executed at Mumbai, "A" was appointed as a master of ship "XYZ". "A" boarded the ship from Philippine. "A" after working for one day refused to work stated that he is not comfortable in doing this job and returned back to india. all the cost made by the company on his travel were wasted. at the time of returning to india "A" has given assurance that he will pay all the amount which the company has incurred on him. after "A's" reaching india company tried to contact "A", but his where abouts are known.

so under these circumstance either i file a private complaint against "A" for committing breach of contract or for committing breach of trust

when you have a contract you have to file a complaint for breach of contract. Here first it is a breach of contract.
