Dear All,

one employee engaed in double employement, i would like to know which law states regarding double employement of an employee?

Whatever may be the case, 'Employees Service Rules' prohibits such double employment.

it depends on nature of employment and relevant service rules.

it depends on the rules of the two establishment where the employees is presently working.

If either of them or both prohibits the working/engaging in any other occupation,then he/she cannot work at both places

Mr. Parthasarathi Sir,

My client company is pharma company. the person is medical representative, two months back he joined our organization.as per the protocol Medical representative are controlled by the Marketing division, the said person before joining our company already working in another company, but our HR officials not verified his documents properly.After elapse of two months we came to know that he is engaged in double employment. But in our company policy and in his appontment letter there is no specific clause regarding double employment. In the absence of such clause can i take proper action against him?
