presentaion of accused before magistrate

if the accused is produced after 24hrs of his arrest what right accused will have at that stage & what order will magistrate has to pass at that time

It is a clear case Human Rights violations and hence the state govt can be sued for damages.

Magistrate may refuse remand and may suo moto take initiative against the I.O. for illegal detention.
