Case relating to IPC 353

Querist : Anonymous (Querist) 30 June 2015 This query is : Resolved 
Sir/Madam,What are the chances of aquital in cases charged under ipc 353 if the first and 2nd accused are marked "not identifiable"in the chargesheet filed?(the total accused were 6 in number). How long does such cases last with the above stated condition? 3rd to 6 th accused(" all identifiable") were arrested when they questioned the arrest of the first two.There was no physical assault on any cop present there. The police vans were not damaged .What course can this case take and can any compromise be reached with the police which lodged the complaint?Thank you!

As you have disclosed your name in comments section so your identification is complete hence this is now our turn to respond.

Generally police do not make compromise but a lenient view can be got taken while recording the evidence so try for that. Otherwise also, this is the prosecution side which has to prove its case beyond any reasonable doubt. The facts told by you are in your favour.

Thanks for the reply!! Unfortunately I cant find any edit mode for changing 'anonymous' to my name. The police have pictures of some of the last 4 accused and many others who blocked their vehicle. They also claim that the tyres of police van were partially deflated .But a case under destruction of public property has not been recorded.Does this weaken our defence?Since first and 2nd accused are not 'identifiable' what course can the case take? Does cases under Ipc 353 drag on for years ?Please enlighten me.Thank you.
