Dowry - consideration as dowry

My wife blaming in 498A which was lodged against me, on my father and mother, in complaint she stated that at the time of marriage my wife mother given original documents of a plot as dowry.

Here a conclusion for my query as far as my knowledge.... no such property transferred or gifted in the name of my wife nor for me as a husband nor on behalf of my any family members and also my wife not having any ancestral property on behalf of her name.

Now I want to get clarification from respected experts that is when my mother in law has not transfered or changed the rights of her property neither to my wife nor to any of my family members nor to me before marriage and after marriage the period before she left from me, how court will consider as dowry

Dear Mr. Sudhakar,

1. Well, if she adduces such proof then she may gain from what she is alleging. Or else this is big bluff.

2. Contest her to produce the evidence that her mother ever possessed such a plot and even if she does then just giving the title deeds is not deemed as dowry.

Has she mentioned the particulars of the property such as survey number, location etc?If so the allegations are easily verifiable. If false, you can move for discharge.

You should defend yourself in the court of law against the false allegations.

During cross examination, your lawyer can ask her to prove her such allegation with the details of the property namely document, survey number, extent etc., the burden to prove the allegation lies on her.
