Civil suit

(Querist) 28 November 2013 This query is : Resolved 
In civil suit for mandatory injunction lower court passed interim order ,there is no response from other side after 2yrs, now I want to vacate the stay order,

1- should I file petition in the same court

or

2- should I file petition in high court.
