(Querist) 22 November 2013 This query is : Resolved
Hello sir, I was an employee of a big IT company. I joined in august this company and there was bond for one year that If I break this bond, I have to pay 75000 otherwise they would take legal action, i worked there for three months and they paid for for three months but due to some family problem i had to leave that organization and now i dont want to join that again and I am worried whether they would do anything as legal action. they have started contacting me now by e-mails or calls. I am not abvle to pay such big amount, please suggest me this regard. I am so tensed because of this.

No bond is enforceable if the same is beyond human possibilities.
If you could prove that the situation was out of your control, you can avoid it.
Do not loose sleep over ot and inform the company about your decision.

Do not make your family members sign the document.
If you do not work in any managerial position then lodge complaint with Labour Commissioner.

The bond is not slavery, do not worry, they cannot do anything until you have an adverse issues pending with the company namely embezzlement, misappropriations etc.
Rajendra K Goyal (Expert) 25 November 2013
Bond is legally enforceable if claimed by the company and if the company is able to prove that the conditions mentioned in the Bond to enforce the Bond exists.
