An Open Abdominal Hysterectomy was performed on my wife by Dr. Shikha Gupta, Consultant Gynae & Obs. of Metro MAS Heart Care & Multi Speciality Hospital, Jaipur without her/my consent. No consent was obtained for the removal of her reproductive organ. No signatures were taken on the consent form for surgery. THERE WAS NO CONSENT FORM TAKEN FROM US FOR THE SURGERY. The operation was conducted without consent. Can a doctor remove a patient’s organs without consent? I need help from experts for legal action and compensation.

without delay you inform to Medical Counsel of India, Delhi, they will surely get action against him, and same time you file Criminal Case also against the hospital. and more you check with that hospital having proper license for operation to the patients.

no it needs consent of the patient and immediate family relative .complain to medical council

Lodge a complaint to the medical council of india and Rajasthan state medical Council.
Was there any emergency for such operation or the consent could not be taken due to administrative mistake. Whether the family members were totally ignorant about the process or the doctor performed the operation in good faith. All hospitals get such consent invariably in such cases.
Apart from above, you should lodge complaint with the MCI & Raj Med. council.
