Workman - management representative - domestic enquiry.

Can a Office Clerk be a Management Representative / Presenting Officer in Domestic Enquiries ?
YES / NO.

A disciplinry authority can appoint any official as management's representative to present the case on behalf of the management before the inquiring authotrity in domestic inquiry.

Although not manadatory, but it would be better a senior or equivalent to the charged official is appointed as the representative. The presenting official should also be a knowledgeable person to appropriately represent the management's case.

Fully agree with Expert PS Dhingra dcgroup1962@gmail.com ji. The management representative should be knowledgeable with appropriate seniority, who can present the case effectively in the departmental inquiry. There is no legal restriction in entrusting a junior for this work if management has entrusted him under due procedure.

There is absolutely no need for selecting level of PO dependent on the status of Charged Officer. If the management the integrity and competence of 8th standard pass waiter then they can appoint him as PO. It is there case and they have right to select their representative just like the accused having a right to select his representative.
