Housing soceity maintenance clarification.

Hi,

I am from Mumbai, Maharashtra. Our Housing society is charging us all charges, i.e. Sweeper, Lift, Electricity, Society Manager, Miscellaneous charges; as per the flats built up area.

Request you to advice is it correct? If not, can you advice any legal section.

Please help.

CHAPTER VIII LEVY OF CHARGES OF SOCIETY:
under BYE -LAWS OF CO-OP SOCIETY IN MUMBAI AREA is very clear as to which item is common to all, and which is as per area of flat.
Go thru the copy of bye-Law No. 69-71 Book provided to you by your society.
Can get bye-law book from "THE MUMBAI DISTRICT CO-OPERATIVE HOUSING FEDERATION LTD. Vikas Premises, First Floor, 11, Bank Street, Fort Mumbai-400 001

common amneities charges are pyable by all members . it is immaterial whether you use the lift or not . society is bound to recover insurance , electricity , sweeper , water charges etc from members
