Process of warrant of possession

Dear Concerned,

My father filled petition of eviction of property form tenant, he won the case from rent controller as well as from session court, now we have proceeded with warrant of possession as there is no stay from any higher court in india.

The executing authority rent controller is giving date after date to submit the objection from JD, legally what is process for issuing warrant of possassion and how many dates he can give to JD for filling any objection.

No much time is provided for filing the objections. Your lawyer should get the matter resolved within short hearings.

you have won the battle . you will get the posession also as no appeal has been filed .oppose lengthy adjournments .

Sir,

We have already filled application under case flow management being my father sernior citizen aged 76 yrs, but the learned Judge said that he is under transfer will not decide the case whereas till date there are no transfer orders, should we move CM in high court for passing instructions for early disposal of the case.
