Dear Experts
Good Morning..... I have the following quary. Kindly advice me.
Wife of A pensioner who worked in Judicial Department of Government of Maharashtra, expired in Second week of February 2012. In the first week of March 2012, the pensioner himself expired. Wife was nominated to receive family pension. The pensioner's first daughter aged over 45 is still unmarried. Is she is eligible to receive family pension upon death of deceased pensioner? if so please indicate provisions in law and procedure to be adopted. Point of Doubt is whether provisions applicable to Central Govt pensioners is applicable to Maharashtra State Govt Pensioner.

an unmarried daughter dependent upon her father is duly entitled to become a pensioner under family pension rules. Generally rules of Centre and State in this regard are same.

As a supplement to the information provided by Shri Makkad, I may add that pension to an unmarried daughter is admissible till she attains the age of twenty-five years or until she gets married, whichever is earlier. Further to it, family pension is stopped if she starts earning her livelihood.

Verify the pensioner's half whether unmarried daughter has been named and mentioned for the grant of family pension,and if so contact the authorities with the death certifcates for sanction of the family pension.
