Marriage

(Querist) 02 March 2012 This query is : Resolved 
one matrimonial issue. the petitioner filed marriage photos in the court. it was a love marriage. now the respondent the wife of the petitioner is denying the marriage him. she is saying that photos are created and morfed. here main thing is to say that she filed chief affidavit. court gave three times chances but she did not entered the witness box. but she filed written arugments stating that photographer is not examined and eyewitness to marriage is not examined. sir who is liable to call either the petitioner is liable to call the phtographer or eyewitness to the court. why i am asking is though she did not entered the witness box she wrote these two things. the petitioner's mother case as witness and said that the respondent is her doughter in law. for this also she did not contradicted by entering into witness box. when photos are admitted when peitioner proved those photos who is liable to call photographer? or eyewitnes. after some lapse of time it is not possible to secure those persons na sir. then in this case how court will proceed.

Who so ever asserts must prove. As you are relying upon the photographs so you shall have to prove.

Dear Querist
if she denial that she is not in photographs or the photographs can be fake and you can prove that the photographs are genuine, approach the court and issue summon to photographer and send the photographs for forensic check.

You can prove Photos by examining Photographer, and any other persons seen in photograph, who performed marriage ceremony. u also examine yourself, and depose that she is i photograph.

but why u want a wife who deny marriage??

The one who produces the evidence is required to prove.

since it is the man who is claiming the marriage and produced the marriage certificates, it is his obligation to prove the same by calling the photographer and other witnesses of the marriage.

One who desires to produce any evidence in court is expected first to put it before opposite side for its ' admission or denial.
If admitted no formal proof would be required but if denied the same would required to be proved by producing the photographer.

To prove the gentility of the photographs, the negatives have to be produced alongwith./
