Querist : Anonymous (Querist) 23 December 2011 This query is : Resolved 
a private complaint was filed-registered by the ccb-one of the accused in a police officer- evidence all documented-complainant filed his statement u/s.164(5).
as no progress was made sought intervention of the court-police asked to file charge sheet-not complied with.
now the accused have u/s.482 filed a quash-can the complainant file a petition as an intervenor?

advise required urgently-to quote under which section to file the petition as an intervenor??

you going into at premature stage of the proceedings. Anyway the accused has got every right to be heard at the pre-investigation and post-investigation stage. You file petition 482 before highcourt for proper fair and free investigation

In a Private Complaint case, complainant filed his statement u/s.164(5)?

Not applicable. It is applicable in State Case.
