A fraudulent lady is drawing family pension from the Indian Army by furnishing a false marriage certificate. While investigating the background of the fraudulent lady who attempted to grab our property, it came to my knowledge that the lady is drawing Military Family Pension. As my enquiries about the lady revealed me that the lady is an illegitimate wife of the an Army person and from the documents like the death certificate of the legitimate wife, legal heir certificate of the dead Army person, information/document sought from the Army Authorities who recommended the family pension showed me that the lady is drawing family pension by furnishing a false marriage certificate as if she got married after the death of the first wife while she has got five grown up children as on that date as per the legal heir certificate. I informed the Army office which recommended the family pension about the fraud played by the lady in getting the family pension but the Army authorities refused to take necessary action telling me to go to court. I informed the police also which is investigating the property grabbing case on that lady and the police also did not bother to initiate action on this matter. I approached the Armed Forces Tribunal and explained them verbally and they too informed me that I cannot make a complaint as I am no way concerned. If I want file a suit in the court, I was told that what locus standi I have got in the case. How to initiate action on the fraudulent lady ?

Balasi,
If her name was not included by the Military Person, and it is fraud, Complaint to Police.
Ask Court to investigate u/s 156(3)directing Police to register FIR, you being the Complainant.
After all it is Public Money, and Government is paying someone.
Can't you get address of any of Military ,man's children, who can depose, their father never remarried??
Publish in news Papers, how fraudulent persons drain out public money??
Media will bring pressure, and may find so many wives of dead military man !!
it is worth doing.
WP in HC , after police complaint will also help.

Balaji! Can you tel me your status qua the family of deceased armed forces personnel?
You should prepare some person from the family of deceased to come against such fraud otherwise there is no hope of your success as you have seen everywhere. Locus-stnadi cannot be overlooked before the lower judiciary as well as before police authorities.
You can avail writ petition to be filed before High Court but beware you should in hand strong documentary evidence against the alleged lady.

Thank you Rajkumar Sir. The Army person retired in 1947 and died in the year 1984. His legitimate wife died and the two daughters who are aged (around 80 years) are not interested and they are not eligible for the pension. This ileegitimate lady got a false marriage certificate and showing that to the Military authorities, earned her pension. The legal heir certificate clearly shows that she has got five grown up children as on the date of her marriage.
