Divorce

Querist : Anonymous (Querist) 27 September 2011 This query is : Resolved
i want to know that, can anbody send his written consent for divorce against the notice recieved from othr spouse, to the court by post in case he does not want to or able to appear in court in anyother state? if yes, then what is the procedure? please advice.

If you cannot go, at least appoint a lawyer to represent you. There is no provision through which you will be able to send your consent letter for divorce. The mere consent will be foolishness. There may be other allegations in the divorce petition. You have to see and state whether you agree with the allegations or not.

No, you can not send reply by written statement,

Appoint a lawyer, or let it proceed ex-parte.

Someone has to file it in court. Even if u do,U will have to appear in person at the time the court passes the consent decree.

As told already ,you have to options :
1]appear in person or through lawyer before the court to either admit or contest the petition filed against you ;OR
2]Do not appear to attend the case and let it proceed and get decided exparte.

Engage a lawyer, file written statement and personally make statement admitting the divorce.

I agree with common opinions of all experts.

thanks a lot to all of you.i,myself was very much in doubt about it. actually my lawyer suggested that a written statement along with an affidavit made before a notary of other state(in which notary's seal will be there)can be submitted in court and it will be sufficient for ending the case.
