Fir after 13 months of suspension.

I am a nationalized bank officer, put to suspension on false and frivolous grounds and I have duly submitted my replies with supporting documents to each and every point in 'remarks call' made upon me. Now, even after 13 months having been elapsed, no charge sheet have been submitted. Instead, now my bank has file an FIR with the economic intelligence wing of the local police.Now, please advise me what to do.

In any criminal offence, the department/ organisation cannot take any action without lodging a complaint with the appropriate wing of the police.
Charge Sheet can be served only after the investigation is conducted properly and after the Disciplinary Authority decides about the severity of the charge and whether to lodge a complaint with the police, or to serve the employee with a major penalty charge sheet or a minor penalty charge sheet, which takes its own time.
So, it is better not to proceed to hit the target in dark and wait patiently before you are able to get proper documents concerning the case, either through the police case or on issue of the charge sheet by the disciplinary authority.
Any impatience shown by you can prove to be harmful to your interest only as in that case you would be able to defend your case on the basis of half truth only as may be available with you merely on presumption basis.

You have very limited options now. FIR can be filed after due departmental internal enquiry without impleading you therein.
If disciplinary proceedings are pending, you my demand 75% salary viz, subsistence allowance s enquiry has not complete within 6 months of your suspension.

You state the FIR has been filed,if i am not mistaken in my understanding of your query,even before serving any charge sheet,then my counter query is, have they named you too in the FIR??????????

In reply to Mr Prabhakar Singh, I would like to inform you sir, that, since, I was the manager of that branch, I have been named in that FIR. Moreover, sir, my computer operator has already confessed and deposited a sum of Rs 400000 and then died of heart attack. Since, he is no more, the department is gunning after me.

Would you like to share the entire facts involved in the case,i am inclined to ask it think more about it in view of deposit made by the computer operator and to what degree your involvement is being imputed and why????

You have not provided the contents of Remarks Call dated 29-11-2010 with reference to which you gave your reply on 3rd February 2011. Can you provide the same also to check relevance of your reply with reference to the requirement of the call?

You may scan or type the same, as it would not be easy to link with the official version and your reply without that. Review based on your reply would merely be one-sided story without reading the mind of the management.
