Take necessary action as mentioned in Bond agreement on breach of it.
Deepak Nair (Querist) 26 September 2011
Dear Sirs,
The clause of bonod states that:
"In case of violation of the terms and conditions of the policy, the Employer will be entitled to initiate strict legal action against the Employee."

The bond is a simple one without so many clauses, discriptions and explanations. No specific legal action is mentioned in the bond. Please advise, what legal action can be taken in such a situation??
Sailesh Kumar Shah (Expert) 26 September 2011
common opinion has already given by the experts. for specific opinion, you have to put entire clauses of the bond, without this no definite opinion can be framed.

The clause of bonod states that:
"In case of violation of the terms and conditions of the policy, the Employer will be entitled to initiate strict legal action against the Employee."

If that is the clause the employer has to first prove before the court what breach has in fact has taken place due to the latches of employee and also what damages in terms of money has been caused to the employer due to alleged breach.
IF EMPLOYERS FAILS TO PROVE AFORESAID TWO THINGS IT SUIT SHALL ALSO FAIL.
