My grandfather's property issue

Hi All,

I have a question.Actually My GrandFather(My Mother's Father) has a property that is not noticed by anyone but now we came to know that the property is in my Grandfather's Name
now my GrandFather is no More now.he Has having 8 childrens(4 sons and 4 daughters).In that 3 sons and 1 daughter are died.Please tell me the process so that we can apply to get the property.

Whether your grand mother (deceased grand father's wife)is alive?

Please indicate whether the 3 sons and 1 daughter who have died, have any children?

Your mother if alive or she is also expired then either of you legal heirs of your mother may file a civil suit for partition and possession of the mentioned properties. suit can be filed wherein the property situates and all legal heirs of your deceased grand-father are to be impleaded as parties to the suit.

both my grandmother and grandfather has expiered.3 sons who are expired has childern and 1 daughter doesn't have any child.

First the surviving son(s)/daughter(s) of the grand father, have to apply for legal heir certificate, wherein they have to show the name of the deceased brother(s)/sister(s) also and indicate that they are deceased.

Thereafter, the son(s)/daughter(s) of the deceased persons should also apply for their respective legal heir certificates by attaching the Death Certificate of their respective deceased parent.

Once such legal heir certificate is obtained, then on that basis you have to get the property partitioned, and then apply for and get the mutation recorded.
