About a plot deal

sir actually my dad has a plot and we have made an agreement with a party for 47 lakhs.he has paid 10 lakhs as advance and said remaining amount will be given within 90 days. we made this on agreement on 100 rs bond paper..this agreement has done 2 years ago. he hasn't paid remaining amount till now. he said he cannot pay. i want to know wether he has any right on our property. does those 100 rs bond papers are valid till now.. i need your help..

You have not mentioned the terms of agreement executed between you and buyer. What was date of registration and what was mentioned the consequences if either of the parties fails to perform its part of contract?

Yes. You can proceed as per the contents of your agreement. If there is any specific time limit for pay the remaining balance mean already the time period elapsed mean, the buzzer failed to obey the terms. So you can repay the advance amount. And may sell it to any one as of your wish.

Even for a humanity if you like mean just issue a legal notice to your buyer and call upon to pay the remaining amount with 15 days time. If he failed mean you can proceed further.

The agreement will remain valid for another year. In view of his inability, U R advised to cancel the agreement after giving him a final opportunity & proceed to sell to someone else.
